TERMS & CONDITIONS

HOLDS + CONFIRMATIONS: The Agency reserves the right to release any holds/provisional bookings within 96hours of the scheduled start time if the Client has not confirmed the booking.

CONFIRMATION OF BOOKING: The failure to sign and / or return the booking confirmation/quote whilst proceeding with the booking will be deemed to be an acceptance by the Client of these terms and conditions and they shall apply to and govern the booking between the Agency and the Client. Any amendment and / or variations made to the booking confirmation form by the Client shall not be valid and binding unless the Agency has agreed to such amendment and/or variation in advance and confirmed such agreement by signing the booking confirmation form after the amendment and/or variation has been included on the booking confirmation form.

OVERTIME & WORKING HOURS: Please note that if a shoot wraps earlier than planned, the full rate must still be paid. The Agency does not bill in half hour increments. No overtime is charged for the first 20 minutes into the next hour but beyond 20 minutes, overtime will be charged at the agreed hourly rate. Booking times are inclusive of required setup/pack down for all artists.

TRAVEL: Travel rates are applicable for travel to shoot locations 20kms or further from the Melbourne GPO. 

CANCELLATION FEES:  If a booking is cancelled within 4 working days (96hrs), 50% of the agreed fee will be charged. If a booking is cancelled within 3 working day (72hrs), 100% of the agreed fee will be charged. Saturdays, Sundays and Public Holidays are excluded for the purpose of determining the cancellation period.

DEPOSITS/PREPAYMENT: All bookings with a total fee of $1500 or less require pre-payment in full and the funds must be received 4 business days prior to the shoot. Bookings with a total fee of $1500 or more require a 50% deposit to secure the booking, with the remainder payment due no later than 7 business days from the shoot.

LATE PAYMENTS: Should an invoice remain unpaid after its due date, a grace period of 5 business days will be allowed. Beyond this grace period, the Agency reserves the right to apply a late fee of 10%, of the total invoiced amount, per week, until the outstanding balance is settled.

AGENCY SERVICE FEE: The Agency Service Fee (ASF) is a charge on all bookings made with the Agency for all Clients. The ASF is calculated at 15% - 20% (GST exclusive) of the Total Talent Fee for all jobs (including usage fees).

MEALS & PARKING: Client is to provide catering for shoots longer than 4hours in duration. Unless otherwise agreed, parking costs accrued by the Talent will be reimbursed by the Client.

SUPERANNUATION: The current Superannuation rate is 11.5% Please refer to the ATO Guidelines available here http:/www.ato.gov.au/business-and-organizations/super-for-employers/work-our-if-you-have-to-pay-super/super-for-independent-contractors

USAGE & IMAGE OWNERSHIP: 12months web + social usage is included within all photographic and videography rates. The content created by the Talent is to be used only as specified above. Any usage outside the Usage Territory, outside of the agreed Usage Period or in any way not specified above will incur additional fees. Please contact the Agency if you would like to extend or edit the usage agreement.  The Talent will be the first owner of copyright, unless the Agency and Client agree otherwise in writing.

POST PRODUCTION/EDITING/RETOUCHING: Please note all post production rates include one round of revisions. Additional rounds of editing will attract additional fees. Our retouching services include grading, light adjustments, cropping and light skin clean ups. Colour matching and extensive retouching requirements are to be discussed and flagged with the agency. Depending on the requirements we may recommend outsourcing the editing.

AGENCY RESPONSIBILITIES + INSURANCE: The Agency is not the Talent’s employer. The Agency acts as the agent facilitating bookings on the talent’s behalf. The Agency has permission to bill and remit all funds on the Talent’s behalf. It is the Client’s responsibility to ensure that they provide a safe workplace and hold the appropriate insurances to cover the Talent and crew during the course of the booking.

CONCERNS/COMPLAINTS: Any and all complaints and concerns in regard to the booking process should be communicated with the Agency prior to the time of booking. Complaints cannot be considered and/or dealt with effectively after the booking is complete.

STYLING: The Client understands that any damage, including but not limited to staining, ripping or tears sustained to any garments loaned or provided by the stylist will be the sole responsibility of The Client. All costs relating to damaged or destroyed garments and styling pieces will be charged back to The Client.
